When a homeowner becomes delinquent on their mortgage, the lender usually begins foreclosure proceedings within 4 months. The foreclosure process starts by a court action being filed by the lender, along with the filing of a lis pendens. The Homeowner is then given a notice of foreclosure. The Homeowner has 20 days to file an answer and affirmative defenses to the action. If the homeowner does not answer within the 20 days, the lender will file for default. Once the lender does this, they will will file a Motion for Summary Judgment and set a hearing on the Motion. At the hearing, a date will be set for the foreclosure sale. The notice is published with the sale time, date and location, and the property will usually be sold within 20-30 days. Ten days after the sale, a transfer of ownership is given to the buyer if there has been no dispute of the sale. The entire process takes approximately 4 months, after which you will be forced to vacate your home.
